1. Basic information

1.1. This Privacy Policy of FIINYX VISION s.r.o., with its registered office at Plk. Fr. Štičky 54, 252 26, Roblín, Czech Republic, Company ID No. 23120541, registered with the Municipal Court in Prague under File No. C 421726 (hereinafter referred to as “Fotobatohy”), sets out the principles governing the processing of personal data of visitors to the website www.fotobatohy.cz and the application (hereinafter referred to as the “Website/Application”), in particular its registered users (hereinafter referred to as “Users”) and customers of the Fotobatohy online store who place an order through the Website (hereinafter referred to as “Customers”).

1.2. Fotobatohy acts as the controller of personal data and determines the purposes and means of processing personal data.

2. What data do we process?

2.1. Data provided by Customers. The Fotobatohy online store processes personal data of Users and Customers. We primarily process the personal data you provide yourself when registering with Fotobatohy or placing an order.

2.2. These data include, in particular, your email address and, in the case of Customers, your first and last name, address, telephone number, payment details (excluding payment card details), login and identification details, information about ordered goods or services, and information about the agreement and its performance. You may also choose to provide additional information, such as your work address, date of birth or a note about possible delivery times.

2.3. Data from Facebook. If you register using Facebook, you also allow the Fotobatohy online store to access your public profile, date of birth, current location information and email address. Depending on your settings, your public Facebook profile includes your first and last name, profile picture, age group, gender and other public information.

2.4. Data from Twitter. If you register using Twitter, you also allow the Fotobatohy online store to access your public profile, date of birth, current location information and email address. Depending on your settings, your public Twitter profile includes your first and last name or nickname, profile picture, age group, gender and other public information.

2.5. Data from Seznam. If you register using Seznam, you also allow the Fotobatohy online store to access your public profile, date of birth, current location information and email address. Depending on your settings, your Seznam profile includes your first and last name or nickname, profile picture, age group, gender and other public information.

2.6. Data collected through cookies. To better target advertising campaigns and improve our range of products and services, Fotobatohy uses information about products purchased by our Customers. If you have enabled the storage of cookies in your browser and agreed to their use, Fotobatohy collects data about visits to the Website, products viewed and other activity on the Website.

2.7. The Fotobatohy online store does not collect or otherwise process any sensitive personal data, such as information about your health, religion or beliefs.

3. For what purposes do we process data?

3.1. To process your order, i.e. to perform the agreement between Fotobatohy and the Customer, we use your first and last name and contact details. In this case, data processing covers all activities from recording and processing the order to payment and delivery of the ordered goods. The processing is necessary for the performance of the agreement and for compliance with legal obligations. Without the required information, Fotobatohy cannot process your order.

3.2. To offer Fotobatohy products to Customers through commercial communications, we primarily use email addresses and occasionally telephone numbers for sending SMS messages. In this case, we send commercial communications about products related to goods you have previously purchased from Fotobatohy. This processing is carried out on the basis of Fotobatohy's legitimate interest in limited direct marketing. Therefore, Fotobatohy does not require consent to send these commercial communications, but you may unsubscribe or object to this processing at any time. We may also send commercial communications to Customers who register as part of an order after these rules have entered into force on the basis of their consent to receiving commercial communications. Such consent is entirely voluntary, and withholding it has no effect on completing your order. You give Fotobatohy consent to receive commercial communications during registration or later in your User Account settings. Please note that only persons over 16 years of age may register with Fotobatohy. You may withdraw your consent at any time by clicking the relevant link in each commercial communication or through your User Account settings. If you withdraw your consent, we will no longer use your data to send commercial communications, including on the basis of the Fotobatohy online store's legitimate interest described above.

3.3. To make ordering at Fotobatohy easier and faster, we use the details you have entered in your User profile during registration or when placing a previous order. These details simplify future purchases by pre-filling the order form. In this case, we process your personal, identification, contact, login and address details because this is necessary for performing an agreement or taking steps before entering into an agreement in connection with managing your User Account. Providing these details in your User profile for the purpose of pre-filling the order form is entirely voluntary and has no effect on completing your order. You may delete or amend the information in your User profile, or cancel your registration, at any time; see Section 4 of this document.

3.4. To notify you when a product that is currently out of stock at the Fotobatohy online store becomes available again, we use the personal data you provide through the “Product tracking” form. In this case, we process your personal data on the basis of your consent to receiving a restock notification. This consent is entirely voluntary and may be withdrawn at any time by clicking the “Cancel” button on the product page, by emailing info@fotobatohy.cz, or through the other contact details provided in this document.

3.5. To comply with legal obligations relating to the submission and handling of complaints concerning goods or services supplied by the Fotobatohy online store, we use the information included in the complaint form. Processing in this case is based on compliance with a legal obligation. If you believe that goods you have purchased are defective, you may provide your personal data using a complaint form or accompanying letter sent by post or another carrier, or by completing the form at the registered office of FIINYX VISION s.r.o. In this case, we process your identification, contact and address details, as well as information about the goods or services ordered, the agreement and the performance of the agreement by both parties. Under the applicable law, where you are a consumer, the Fotobatohy online store is obliged to process the personal data needed to enable you to submit a complaint and, where appropriate, handle a complaint concerning goods or services supplied by the store. Where the Fotobatohy online store is not legally obliged to allow a complaint but chooses to do so, we process the personal data necessary to handle the complaint and thereby fulfil our contractual obligations.

3.6. To improve advertising targeting and promote the Fotobatohy online store, we use cookies to process data about visits to the Website, products viewed and other Website activity. This processing is only possible with your consent to the use of the relevant cookies. Such consent is entirely voluntary. These data generally allow the Fotobatohy online store to obtain statistics, analyses and reports about the behaviour of Website Users. This information can then be used to target advertising more effectively or tailor Website content to what you are looking for and interested in, or to the interests of larger groups of Users. 3.7. To provide customer support, we use the name and email address that you may, but are not required to, enter in the chat window while communicating with an employee of the Fotobatohy online store on the Website. By entering these details, you consent to their processing. We do not use your name or email address for any further purposes solely because you have started a chat.

3.8. We assess your satisfaction with your purchases through email surveys sent as part of the Verified by Customers programme, in which our online store participates. We send these surveys whenever you purchase from us, unless you opt out of receiving them pursuant to Section 7(3) of Czech Act No. 480/2004 Coll., on Certain Information Society Services. The processing of personal data for sending surveys under the Verified by Customers programme is based on our legitimate interest in assessing your satisfaction with purchases from our store. To send surveys, evaluate your feedback and analyse our market position, we use the operator of the Heureka.cz portal as a processor. For these purposes, we may share your email address and information about purchased products with this processor. Your personal data are not disclosed to any third party for that party's own purposes in connection with sending these email surveys. You may object to receiving surveys under the Verified by Customers programme at any time by using the opt-out link included in the survey email. If you object, we will no longer send you such surveys.

4. Withdrawal of consent and unsubscribing from commercial communications

Users and Customers of the Fotobatohy online store may unsubscribe from commercial communications at any time by:

clicking the relevant link in the footer of each commercial communication; or
objecting to the processing of personal data by the Fotobatohy online store by emailing info@fotobatohy.cz or using the other contact details provided in this Policy.

If you want to prevent cookies from being stored on your device, you can change your browser settings or click the Cookie settings link in the footer of each page of the Website. If you disable cookies used by Fotobatohy, some parts of the Website may not function properly.

5. Who has access to the data?

5.1. Personal data are primarily processed by Fotobatohy and its staff. All persons with access to personal data are bound by confidentiality obligations, which remain in effect even after their cooperation with the Fotobatohy online store ends.

5.2. As the controller, Fotobatohy also entrusts the processing of personal data to other entities known as processors. A processor is any entity that processes personal data on behalf of Fotobatohy for the purposes and by the means specified by Fotobatohy. Where your consent is required for processing, we transfer data to processors only if you have given that consent. We provide processors only with the data they need to deliver their services. Processors used by the Fotobatohy online store include:

6. How long do we process data?

6.1. The Fotobatohy online store processes personal data for the performance of an agreement throughout the handling of an order, including payment and delivery of the goods. The Fotobatohy online store is subsequently required by law to retain certain data contained in accounting documents.

6.2. Commercial communications are sent to Users for as long as their consent remains valid. In the case of Customers, commercial communications are sent until they unsubscribe or object to the processing of their data for this purpose. In any event, commercial communications are sent for no longer than 10 years. After that, the Fotobatohy online store will request new consent.

6.3. The Fotobatohy online store processes data collected for marketing purposes through cookies for as long as consent to the use of cookies remains valid, i.e. while you allow cookies to be stored in your browser, or until you object to the processing of your data for this purpose.

6.4. Fotobatohy processes personal data beyond the periods stated above only where necessary to comply with legal obligations applicable to Fotobatohy.

7. What are your rights?

7.1. In connection with the processing of your personal data, you may contact Fotobatohy and request:

Information about the personal data processed by the Fotobatohy online store, the purpose and nature of the processing, including information about any recipients of personal data outside Fotobatohy. General information about our personal data processing activities is contained in this Policy.
Access to the data you provided to the Fotobatohy online store, whether during registration or when placing an order. If you exercise this right, Fotobatohy will confirm whether and which personal data are being processed and, where applicable, provide access to those data together with information about their processing.
Correction of your personal data if they are inaccurate or incomplete. The Fotobatohy online store can process your order correctly only if your data are up to date.
An explanation and remedy of an unlawful situation (such as blocking, correcting, supplementing or deleting personal data) if you believe that the Fotobatohy online store processes personal data in a manner contrary to the protection of your personal and private life or contrary to applicable law.
Erasure of personal data (the so-called “right to be forgotten”) or restriction of their processing if they are no longer needed for the stated purposes or if the Fotobatohy online store no longer has a lawful basis for processing them, including where you object to further processing. If these conditions are met, Fotobatohy will erase your data in whole or in part.
Transfer of automatically processed personal data obtained on the basis of your consent from Fotobatohy to another entity, whereby the Fotobatohy online store will provide your personal data in a commonly used format to you or, at your request, to another controller.

7.2. Customers of the Fotobatohy online store may also object to the processing of personal data for sending commercial communications or evaluating purchasing preferences, in which case Fotobatohy will immediately stop processing personal data for these purposes.

7.3. In addition to the rights mentioned above, you may always lodge a complaint with the Czech Office for Personal Data Protection if Fotobatohy breaches its obligations.

8. Security

8.1. The Fotobatohy online store takes the security of your data seriously. Personal data are handled in full compliance with applicable law, including the General Data Protection Regulation (GDPR). The Fotobatohy online store places great emphasis on the technical and organisational security of the data it processes.

8.2. All personal data in electronic form are stored in databases and systems accessible only to persons who need to handle personal data directly for the purposes stated in this Policy, and only to the extent necessary. Access to these personal data is protected by passwords and a firewall. The Fotobatohy online store regularly tests the security of personal data and continuously improves its protection.
